Wensen An

Dr. Wensen An holds the qualification of Chinese lawyer and patent agent. He is a senior intellectual property engineer and has been engaged in intellectual property work for nearly 15 years. His main fields of practice are intellectual property protection and commerce application, data compliance and privacy protection. He has represented thousands of cases of domestic and foreign client, including many of the world's top 500 enterprises, from patent layout, patent writing, patent application, patent invalidation litigation, patent validity analysis, patent navigation to brand protection, intellectual property due diligence and risk prevention and control and data governance, etc.Thanks to years of scientific research experience in well-known research institutions at home and abroad, Dr. Wensen An is good at the technical fields including artificial intelligence / machine learning, autonomous driving, intelligent manufacturing, medical devices, etc. 

Mr. Wensen An graduated from the University of Science and Technology of China， with a doctor's degree in engineering and he was a law graduate student at the China University of Political Science and Law. Before joining the PacGate law firm, he worked for a top domestic intellectual property agency and an international first-class intellectual property law firm.

• Represented a well-known domestic technology enterprise in a patent invalidation proceeding. Despite highly unfavorable evidence for the client, tactful strategy led the petitioner to withdraw its invalidation request after the oral hearing;

• Provided brand protection services for a domestic enterprise. Overcoming multiple obstacles, we secured police filing of the case, coordinated simultaneous enforcement raids across multiple locations, seized infringing moulds, obtained convictions against multiple infringers, and recovered nearly RMB 10 million in compensation for the client;

• Served as the sole law firm representative on the editorial board comprising more than ten banks and other institutions, and authored the Research Report on Open Banking Data Sharing and Compliance, which was officially released at the 2021 Chengfang Fintech Forum & Global Fintech Summit;

• Developed systematic, commercially aligned resolution strategies for domestic clients’ IP disputes;

• Provided STAR Market-listed enterprises with patent navigation, patenting strategies, patent portfolio planning and trade secret risk control frameworks;

• Served as ongoing IP counsel for domestic enterprises, focusing on IP protection and enforcement strategies covering patents, trade secrets and unfair competition;

• Advised domestic and foreign smart manufacturing, environmental technology and medical device enterprises on IP infringement analysis, defence strategies for serial patent invalidation, patent stability opinions, patent litigation plans and patent protection schemes;

• Co-authored the China AI Industry IP White Paper for 2020 and 2021;

• Invited by the Beijing IP Rights Protection and Assistance Center and the Capital Intellectual Property Services Association to participate in the project analysing typical overseas IP litigation cases of Chinese enterprises, and received commendation.
